These Terms of Sale ("Terms") govern the purchase of all products, including flowers, chocolates, and other gifts (collectively, "Products"), from our e-commerce platform. By placing an order with The White Boutique, you agree to be legally bound by these Terms. These Terms are established in compliance with the UAE law.
We strongly encourage you to carefully review these Terms and Conditions, along with any other applicable terms, before making a purchase or using our services. By accessing or using the platform, creating an account, completing any transaction, or taking any action on the website, you expressly agree to be bound by these Terms and any amendments or modifications thereto, as updated from time to time.
2. Product Information & Availability2.1. Product DescriptionsWe take all reasonable care to ensure that all details, descriptions, and prices of Products appearing on our website are accurate and up to date. However, as our floral arrangements are handcrafted by skilled florists and feature natural products, slight variations in color, size, and style may occur. Similarly, our chocolate products are artisanal in nature and may vary slightly from the images displayed. All photographs and images on our website are for illustrative and guidance purposes only and should not be relied upon as exact representations of the final product.
2.2. Availability & Substitution PolicyAll Products are subject to availability and seasonal variations. In the event of any supply difficulties, adverse weather conditions affecting flower quality, or if the flowers we have received from our growers do not meet our high-quality standards, we reserve the right, at our absolute discretion, to substitute any product with an alternate product of a similar style and equivalent (or greater) value and quality. This substitution policy is necessary to ensure your order arrives on time and meets our quality standards, especially for same-day deliveries. We will always endeavor to maintain the overall aesthetic and color scheme of your chosen arrangement. If a suitable substitution cannot be made, we will contact you to discuss alternative options or offer a full refund.
3. Pricing & Payment3.1. PricingAll prices are listed in UAE Dirhams (AED) and are inclusive of any applicable Value Added Tax (VAT) at the prevailing rate. Prices displayed on our website are subject to change without prior notice, but such changes will not affect orders that have already been confirmed and accepted by us, this will not apply if the price mentioned on the Website was mistaken written or has any typo.in this event we will have the full right to amend the Price and if you accept to continue the transaction or cancel the order. A separate delivery charge may apply, which will be clearly indicated during the checkout process before you complete your purchase. We reserve the right to correct any pricing errors on our website or on pending orders made based on incorrect pricing.
3.2. Payment MethodsPayment for all Products must be made at the time of placing your order. We accept the following payment methods:
• Major credit cards (Visa, Mastercard, American Express)
• Debit cards
• Digital wallets (Apple Pay, Google Pay, Samsung Pay)
• Buy Now, Pay Later (BNPL) services through authorized third-party providers
Payment will be debited from your account upon or shortly after you place your order. All payment transactions are processed through secure, encrypted payment gateways to protect your financial information. The White Boutique does not store your complete credit card details on our servers.
3.3. Payment AuthorizationBy providing your payment information, you confirm that you are authorized to use the payment method provided and that sufficient funds or credit are available to cover the purchase amount. If we are unable to obtain payment authorization, we reserve the right to cancel your order and will notify you accordingly.
4. Buy Now, Pay Later (BNPL)The White Boutique offers Buy Now, Pay Later (BNPL) options through licensed third-party providers operating in the UAE. Should you choose a BNPL payment method at checkout, you will be entering into a separate credit agreement directly with the BNPL provider.
4.1. BNPL Provider TermsYour payment schedule, installment amounts, late payment fees, and all other terms and conditions related to the BNPL service are governed exclusively by the terms and conditions of the respective BNPL provider (such as Tabby, Tamara, or other licensed providers). We strongly encourage you to read and understand the BNPL provider's terms before selecting this payment option.
4.2. LiabilityThe White Boutique is not a party to your agreement with the BNPL provider and is not responsible for any fees, charges, interest, or penalties imposed by them. Any disputes regarding BNPL payments must be resolved directly with the BNPL provider. However, our standard cancellation and refund policies (as outlined in Section 7) will still apply to the original order.
5. Delivery PolicyWe are committed to delivering our beautiful Products in a timely, professional, and secure manner across the UAE.
5.1. Delivery AreasWe deliver to all seven emirates of the UAE, including residential addresses, business addresses, and hotels. Please ensure you provide a complete and accurate delivery address, including building name, villa/apartment number, street name, area, and any special delivery instructions. We cannot be held responsible for failed or delayed deliveries resulting from incomplete or incorrect address information.
5.2. Delivery TimesWe offer various delivery time slots, including same-day delivery (subject to availability and order placement time), next-day delivery, and scheduled delivery for future dates. While we endeavor to deliver within the selected time slot, these are estimates and cannot be guaranteed due to factors beyond our control, such as traffic conditions, weather, or recipient availability. We will make every reasonable effort to meet your requested delivery time.
5.3. Recipient AvailabilityIt is your responsibility to ensure that the recipient (or an authorized person) will be available at the delivery address on the specified date and during the estimated delivery time. If the recipient is not available:
• Our courier will attempt to contact the recipient using the contact number provided
• The courier may leave the Products with a neighbor, building reception, or security personnel
• The courier may leave the Products in a safe location at the delivery address (with your prior consent)
• If delivery cannot be completed, we will contact you to rearrange delivery, which may incur an additional delivery charge
We cannot be held responsible for the condition of Products after they have been successfully delivered and left in accordance with the above procedures.
5.4. Delivery ChargesDelivery charges vary based on the delivery location, time slot, and urgency of delivery. All applicable delivery charges will be clearly displayed during the checkout process before you complete your purchase.
6. Gift CardsThe White Boutique offers Gift Cards that can be used to purchase any Product on our website. Our Gift Card policy is designed to be flexible, user-friendly, and compliant with UAE consumer protection standards.
6.1. RedemptionGift Cards are redeemable for merchandise only and can be used to purchase any Products available on our website. Gift Cards cannot be exchanged for cash, unless required by applicable UAE law. If the purchase amount exceeds the Gift Card balance, the remaining amount must be paid using another accepted payment method. If the purchase amount is less than the Gift Card balance, the remaining balance will stay on the Gift Card for future use.
6.2. No Expiration or FeesOur Gift Cards have no expiration date and are not subject to any service fees, dormancy fees, or maintenance charges. Your Gift Card balance will remain valid indefinitely until fully redeemed.
6.3. Non-RefundableGift Cards are non-refundable and cannot be returned for a cash refund, except where required by law. Once a Gift Card has been purchased and issued, it cannot be cancelled.
6.4. Lost or Stolen CardsThe White Boutique is not responsible for lost, stolen, damaged, or unauthorized use of Gift Cards. Gift Cards should be treated like cash.
6.5. Terms and ConditionsGift Cards are issued by The White Boutique and are subject to these Terms of Sale. We reserve the right to refuse to honor any Gift Card that we believe has been tampered with, duplicated, obtained fraudulently, or the requested cash to be credited to the Gift Card exceed the minimum threshold requested by Us.
7. Cancellation, Returns, and RefundsOur policy is designed to be fair to both you and our business, while respecting the perishable and time-sensitive nature of our Products.
7.1. Order Cancellation by CustomerDue to the urgent nature of preparing and dispatching our fresh Products, particularly floral arrangements which are prepared specifically for your order, the window for cancellation is limited.
Cancellation Timeframes:48 hours or more before scheduled delivery – Full refund to original payment method
Between 24-48 hours before scheduled delivery – Partial refund (50%) or full store credit (at customer's choice)
Less than 24 hours before scheduled delivery – No refund (order preparation has commenced)
If the Product customizes only for you based on your request – No refund, no cancellation at any time.
How to Cancel:To cancel an order, please contact our customer service team immediately via phone, email, or live chat (contact details in Section 12). Please provide your order number and reason for cancellation. Cancellation requests are processed based on the time we receive your request, not the time you attempted to contact us.
7.2. Returns & Refunds for Quality IssuesAs flowers and chocolates are perishable goods, they cannot be physically returned to us. However, we stand firmly by the quality of our Products and are committed to your complete satisfaction.
Reporting Quality Issues:• You must contact us within 24 hours of delivery if you receive a Product that is damaged, defective, wilted, melted, or does not meet our quality standards
• Please provide your order number, a detailed description of the issue, and clear photographic evidence showing the problem
• Our customer service team will review your claim and may request additional information
Resolution:Upon verification of a legitimate quality issue, we will, at our sole discretion, offer one of the following remedies:
• A replacement Product delivered at no additional charge
• A full refund to your original payment method
• Store credit for the full order value plus a goodwill gesture
We are not liable for quality issues reported after the 24-hour window, or for issues arising from improper care, storage, or handling of Products after delivery.
7.3. Order Cancellation by The White BoutiqueWe reserve the right to cancel any order, before or after acceptance, in the following circumstances:
• If we are unable to obtain authorization for your payment
• If the delivery address is outside our designated delivery areas or is inaccessible
• If a Product is out of stock and a suitable substitution cannot be made
• If we identify a pricing or product description error on our website
• If we suspect fraudulent activity or misuse of our services
• If delivery is prevented by circumstances beyond our reasonable control.
If we cancel your order, we will notify you as soon as possible via email or phone. Any payment already received will be refunded in full to your original payment method within 7-14 business days.
8. Intellectual Property Rights8.1. OwnershipAll content on The White Boutique website, including but not limited to text, graphics, logos, images, photographs, product designs, floral arrangements, videos, audio clips, digital downloads, data compilations, and software, is the property of The White Boutique or its content suppliers and is protected by UAE and international copyright, trademark, and other intellectual property laws.
8.2. Trademarks"The White Boutique" name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of The White Boutique or its affiliates or licensors. You must not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on this website are the trademarks of their respective owners.
8.3. Restrictions on UseYou may access and use our website for personal, non-commercial purposes only. You are not permitted to:
• Reproduce, duplicate, copy, or resell any part of our website or Products for commercial purposes
• Modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content, information, software, products, or services obtained from our website
• Use our product images, floral designs, or photographs without our express written permission
• Remove or alter any copyright, trademark, or other proprietary notices from any content on our website
• Use any automated system or software to extract data from our website (screen scraping, data mining, or similar data gathering tools)
9. Limitation of Liability9.1. Maximum LiabilityTo the fullest extent permitted by UAE law, our total liability to you for any claims arising out of or related to your order or use of our Products shall not exceed the total amount you paid for the specific Product that is the subject of the claim. This limitation applies regardless of the legal theory upon which your claim is based.
9.2. Allergen DisclaimerIMPORTANT - PLEASE READ CAREFULLY:
Our chocolate products may contain or come into contact with common allergens including, but not limited to:
• Tree nuts (almonds, hazelnuts, pistachios, cashews)
• Peanuts
• Milk and dairy products
• Soy and soy lecithin
• Wheat and gluten
• Eggs
While we take reasonable precautions to provide accurate allergen information, our Products are prepared in facilities that handle multiple allergens, and cross-contamination may occur. The White Boutique cannot guarantee that any Product is completely free from allergens.
If you or the recipient has any food allergies or dietary restrictions, it is your responsibility to contact us before placing an order to discuss specific ingredients and potential allergen risks. We strongly recommend that individuals with severe allergies avoid consuming our chocolate products.
The White Boutique shall not be liable for any allergic reactions, illness, or injury resulting from the consumption of our Products. By placing an order, you acknowledge and accept this risk.
9.3. Exclusion of Consequential DamagesTo the fullest extent permitted by UAE law, The White Boutique shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business opportunity, or emotional distress.
17. Governing Law17.1. Applicable LawThese Terms of Sale and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the federal laws of the United Arab Emirates as applied in the Emirate of Dubai.
16.2. JurisdictionThe courts of Dubai shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms.
16.3. LanguageThese Terms are drafted in English. In the event of any conflict between the English version and any translation, the English version shall prevail.
16.4. SeverabilityIf any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
16.5. WaiverNo failure or delay by The White Boutique in exercising any right shall constitute a waiver of that right.
16.6. Entire AgreementThese Terms, together with our Privacy Policy and any other applicable terms, constitute the entire agreement between you and The White Boutique.
16.7. Updates to These TermsWe reserve the right to update, amend, or modify these Terms at any time. Any changes will be posted on this website with an updated "Last Updated" date. Your continued use of our website constitutes your acceptance of the revised Terms.
